Clearer regulation of cryptocurrencies
The president of U.S. cryptocurrency exchange FTX, Brett Harrison explained how the company operates and suggested that clearer regulation is needed for the listing of digital assets.
Harrison highlighted the FTX exchange’s limited cryptocurrency offering, arguing that it is the best option under current regulations.
“We have fewer than 30 tokens on our exchange, and we think that’s fortunately or unfortunately the long term play that will work for us until there is better clarity in terms of what registration is going to be required.”
Harrison has believed that more cryptocurrency projects will be willing to register with the U.S. Securities and Exchange Commission (SEC), and will always be available for listing, when a clearer regulatory framework is provided. He noted that many of these projects want to be listed on U.S.-based cryptocurrency exchanges, but are currently banned from implementation due to the lack of clear guidelines.

According to Harrison, many cryptocurrency companies are being prevented from operating in the U.S. due to concerns about future enforcement action. He stated that they want tokens to have “asset-like security” and argued that the U.S. should do more to provide regulatory clarity.
Harrison’s interview follows comments by SEC Chairman Gary Gensler, claiming that many cryptocurrency exchanges and brokers still violate the guidelines set by the regulator.
ETH can be considered a type of security
On September 15, when Ethereum completed the Merge upgrade, Michael Saylor, co-founder and executive chairman of business intelligence software company MicroStrategy Inc. (NASDAQ: MSTR), which implies that $ETH can be classified as security (rather than commodity) by the SEC.

Saylor hopes the SEC will eventually declare that $ETH is a security (unlike $BTC it has publicly called a commodity and therefore not subject to U.S. securities laws).

According to the WSJ report, although Gensler did not specifically mention Ethereum, he said that the native assets of the PoS blockchain could pass the Howey Test because it was possible to view Staking as an “investment contract” because “the investing public is anticipating profits based on the efforts of others.”
